Under Mining Program, Aggregates Mining Advisory Council was formed by Governor in 1995 (Executive Order 01.01.1995.16). Council advised Secretary of Environment on regulating mining of aggregates, mineral materials used to make concrete.

Last met in 2002.

Convened in 1997 by Secretary of the Environment, Attainment Plan Task Force continued work of 15-Percent Plan Task Force, which submitted its final report in January 1996. To attain federal clean air standards for ground-level ozone reduction in Maryland, 15-Percent Plan Task Force recommended emission control strategies to Department.

Attainment Plan Task Force helped develop an attainment plan submitted to federal Environmental Protection Agency in April 1998, and supplemental plan of Sept. 1998. To attain an 8-hour ozone standard in Baltimore area, Task Force then focused on cost-effective and innovative clean-air strategies.

Representatives of State and local governments, industry, and the environmental community comprised Task Force, which last met in Aug. 2004.

Department of the Environment convened Composting Work Group in May 2012 to assist Department in its study of composting in Maryland and in formulating recommendations on facilitating composting in State. Study and resulting findings and recommendations were required by Chapter 363, Acts of 2011.

Work Group reported to General Assembly in Jan. 2013.

Environmental Noise Advisory Council advised Department on environmental noise standards and sound level limits. Council began in 1973 as Noise Pollution Control Advisory Council (Chapter 709, Acts of 1973). It was renamed Environmental Noise Advisory Council in 1974 (Chapter 287, Acts of 1974). Formerly under Department of Health and Mental Hygiene, Council became part of Department of the Environment in 1987 (Chapter 306, Acts of 1987). After being inactive for nearly a decade, Council was re-activated in Dec. 2000 to address needed changes in regulations governing noise pollution.

Eleven members comprised Council. Nine were appointed by Secretary of Environment for five-year terms. Two ex officio members include one senator named by Senate President, and one delegate chosen by House Speaker (Code Environment Article, secs. 3-201 through 3-205).

Due to funding cuts, Council last met in May 2005. Council abolished by Chapter 360, Acts of 2012, effective Oct. 1, 2012.

HAZARDOUS WASTE PROGRAM
In 1977, Hazardous Waste Program formed as Toxic Substances Control Program under Environmental Health Administration of Department of Health and Mental Hygiene. Duties of Program were assigned to Waste Management and Enforcement Program by 1980 and to Waste Management Administration of Department of Health and Mental Hygiene by 1982. They transferred to Department of Environment in 1987.

Under Land Management Administration, Hazardous Waste Program issued permits to and certified all who generate, treat, store, dispose of, or transport hazardous waste in State. Program certified haulers of hazardous waste and drivers of vehicles that transport hazardous waste. In 1993, Program became responsible statewide for managing generation, storage, and removal for disposal of low-level nuclear waste.

Three divisions constituted Program: Hazardous Waste Compliance; Regulations and Permitting; and Tracking and Hazardous Materials Transportation.

Functions dispersed to other programs in July 2011.

INDUSTRIAL HYGIENE DIVISION
In 1989, Industrial Hygiene Division began as Industrial Operations Program under Toxics, Environmental Science and Health Administration of Department of the Environment. Program reorganized into a division under Air and Radiation Management Administration in 1992 and was renamed Industrial Hygiene Division in 1993.

In July 2004, Division functions were taken over by Asbestos Division.

In 1974, Interagency Noise Control Committee was created under Department of Health and Mental Hygiene (Chapter 287, Acts of 1974). Committee transferred to Department of the Environment in 1987 (Chapter 306, Acts of 1987). Although inactive for most of 1990s, Committee resumed meeting from 2000 to May 2005.

From those State agencies responsible for developing, adopting, or enforcing any noise control rule or regulation, Committee received reports. It reviewed State noise control rules and regulations; evaluated existing efforts to comply with standards; and recommended new or revised noise control rules, regulations, or legislation.

Committee consisted of a member of Governor's executive staff, appointed by Governor; and representatives from following executive departments, appointed by their respective secretaries: Business and Economic Development; Environment; Health and Mental Hygiene; Labor, Licensing, and Regulation; Natural Resources; Planning; and Transportation. Member appointed by Secretary of the Environment served as chair (Code Environment Article, secs. 3-301 through 3-304).

Abolished effective Oct. 1, 2012 (Chapter 360, Acts of 2012).

Secretary of the Environment convened Lead Poisoning Prevention Study Group in July 2011. Study Group evaluated issues relevant for reducing lead poisoning, including current data, data collection methods, education and outreach, expanding applicability of current law, and long-term funding for lead poisoning prevention.

On Dec. 31, 2011, Department reported Study Group's findings to General Assembly (Chapter 610, Acts of 2011).

In April 2009, Department convened Pier Task Force to review Maryland laws, regulations, and policy on residential pier construction to determine whether they need to be revised. Task Force considered length of piers over open water; length and height of piers over marshes and related ecological issues; and use of mooring buoys in place of piers. Also under consideration were dredging and its impact on submerged aquatic vegetation; competing recreational uses for waterways; limiting access; waterfront aesthetics; and construction methodology.

Last met in Jan. 2010.

At request of General Assembly, Secretary of Environment convened Solid Waste Management Study Group in Oct. 2010, to help Department evaluate solid waste management processes for reducing solid waste stream through recycling and source reduction (Chapter 719, Acts of 2010).

Work Group reported its findings to General Assembly in Dec. 2011.

TRACKING & HAZARDOUS MATERIALS TRANSPORTATION DIVISION
Under Hazardous Waste Management Administration, Tracking and Hazardous Materials Transportation Division organized as Toxics Information and Operations Center. It reorganized as Toxics Registries and Analysis Program in 1989, Toxic Registries Division of Hazardous Waste Program in 1992, and Tracking and Toxics Inventory Division in 1993. Division reformed as Tracking and Hazardous Materials Transportation Division in 1995.

Under federal Superfund Amendment and Reauthorization Act, Division received and stored information about use of toxics by industry. Division served as a central repository for this data which Maryland counties use to develop emergency response plans.

Ecological effects of toxics, primarily on aquatic environment, were assessed by Division. These assessments were used by Department and local agencies. In addition, Division assisted Department of State Police and Department of Transportation with commercial vehicle safety and transport of hazardous materials.

In July 2008, Wetlands and Waterways Program Fund was established (Chapter 142, Acts of 2008). Through fees for permits, and licences, Department uses Fund to manage, conserve, restore, and protect State's wetlands and waterways. By Jan. 1, 2011, Department was to convene Work Group to evaluate usefulness of Fund; and whether Fund improved service levels within Program.

In Dec. 2011, Department reported Work Group's findings to Legislative Policy Committee; Senate Education, Health and Environmental Affairs Committee; and House Environmental Matters Committee.
